Terms of Service

These Terms of Service ("Terms") govern your use of TeleVerify ("the Service"), a telehealth compliance verification tool. By using the Service, you agree to these Terms.

1. Description of Service

TeleVerify is an informational tool that helps healthcare providers verify location-based regulatory compliance during telehealth sessions. The Service checks whether a provider's licensure permits treatment of a patient in a given state, based on publicly available licensure data and interstate compact memberships.

2. Important Disclaimers

Not Legal Advice: TeleVerify provides informational compliance checks only. Results should not be considered legal advice. Providers are responsible for independently verifying their authority to practice across state lines.

Not an Access Control System: TeleVerify does not block, terminate, or control telehealth sessions or Zoom meetings. It is a documentation and informational tool.

Data Accuracy: Compliance results are based on publicly available NPI Registry data and known interstate compact agreements. While we strive for accuracy, we cannot guarantee that all data is current or complete.

3. User Responsibilities

You agree to: provide accurate information including your NPI and credentials; use the Service only for legitimate telehealth compliance verification; maintain the confidentiality of your account credentials; comply with all applicable federal and state telehealth regulations; and not use the Service for any unlawful purpose.

4. Account and Access

Provider accounts require a valid NPI and email address. You are responsible for all activity under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Zoom Integration

TeleVerify integrates with Zoom via the Zoom Marketplace. By connecting your Zoom account, you authorize TeleVerify to access meeting context for compliance verification. You may disconnect at any time by removing TeleVerify from your Zoom installed apps. Upon disconnection, all Zoom-related data is automatically deleted from our systems.

6. Intellectual Property

The Service, including its design, features, and documentation, is owned by TeleVerify. You are granted a limited, non-exclusive license to use the Service for its intended purpose.

7. Limitation of Liability

To the maximum extent permitted by law, TeleVerify shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages resulting from compliance decisions made based on the Service's output.

8. Warranty Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

10. Termination

Either party may terminate the use of the Service at any time. Providers may delete their accounts through the application. Upon termination, all associated data will be deleted in accordance with our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

13. Subscription Plans, Billing, and Payment

13.1 Subscription Plans. TeleVerify offers subscription-based access through the following plan tiers: (a) Individual, for solo telehealth practitioners; (b) Organization, for group practices, billed per seat; and (c) Enterprise, for large health systems with custom requirements. Features and pricing are described at televerify.org/pricing and may be updated from time to time.

13.2 Free Trial. New subscribers may be eligible for a fourteen (14) calendar day free trial. If you do not cancel before the trial ends, your subscription automatically converts to a paid subscription and your payment method will be charged at the applicable rate. You may cancel during the trial at any time through your dashboard settings without charge.

13.3 Billing Cycle and Payment. Subscriptions are billed in advance on a monthly or annual basis. All payments are processed through Stripe, Inc. By subscribing, you agree to Stripe’s terms of service and authorize recurring charges to your designated payment method.

13.4 Pricing Changes. TeleVerify reserves the right to change pricing upon thirty (30) days’ prior written notice via email. Price changes take effect at the start of your next billing cycle following the notice period. If you disagree with a price change, you may cancel before it takes effect.

13.5 Taxes. All fees are exclusive of applicable taxes, levies, or duties. You are responsible for all such taxes except those based on TeleVerify’s net income.

13.6 Failed Payments. If a payment fails, TeleVerify will attempt to retry per Stripe’s automatic retry schedule and will notify you by email. If payment is not collected within fourteen (14) days, TeleVerify may suspend your access until payment is received.

13.7 Per-Seat Billing (Organization Plans). Organization subscriptions are billed per seat. Adding a provider provisions a new seat with a prorated charge. Removed seats are released at the end of the current billing period; no mid-cycle refunds are issued for seat removals.

14. Cancellation, Refunds, and Account Closure

14.1 Cancellation. You may cancel at any time through the Billing section of your dashboard or by emailing support@televerify.org. Cancellation takes effect at the end of your current billing period. No prorated refunds are issued for unused time.

14.2 Refund Policy. TeleVerify does not offer refunds except for: (a) billing errors, which will be corrected within fifteen (15) business days; (b) material service outages exceeding seventy-two (72) consecutive hours, for which you may request a prorated credit; and (c) discretionary refunds issued by TeleVerify on a case-by-case basis.

14.3 Cancellation by TeleVerify. TeleVerify may suspend or cancel your subscription if you breach these Terms, your account is past due for more than thirty (30) days, or continued service would violate applicable law. No refund is issued for breach-based cancellation. For cancellations not attributable to you, a prorated refund of prepaid fees will be issued.

14.4 Data After Cancellation. Upon cancellation: (a) dashboard access is terminated at the end of the billing period; (b) account and profile data are deleted within ninety (90) days per our Privacy Policy; and (c) compliance verification records are retained for a minimum of seven (7) years per CMS record-keeping requirements. You may request a data export before closure by contacting support@televerify.org.

14.5 Account Deletion. You may request complete account deletion through your dashboard or by email. All personal data and integration tokens will be permanently destroyed. Compliance records are retained per Section 14.4(c). Deletion is irreversible.

15. Service Availability

15.1 Availability. TeleVerify uses commercially reasonable efforts to maintain service availability, hosted on SOC 2 Type II compliant infrastructure with automated health monitoring.

15.2 Scheduled Maintenance. TeleVerify will provide at least twenty-four (24) hours’ advance notice of scheduled maintenance when reasonably practicable.

15.3 No Uptime Guarantee. TeleVerify does not guarantee any specific level of uptime. The Service is provided “as available” per Section 8 (Warranty Disclaimer).

16. Compliance Verification Disclaimer

16.1 Scope of Verification. The Service verifies licensure status and interstate compact eligibility only. The Service does not verify: license restrictions or conditions (probation, practice limitations, supervision requirements); scope of practice limitations; board disciplinary actions; pending investigations; malpractice history; DEA registration status; or state-specific telehealth modality restrictions.

16.2 Data Sources. Compliance results are derived from publicly available sources including the NPPES registry, interstate compact registries (PSYPACT, IMLC, NLC, ASWB Mobility, APRN Compact), and state licensing board publications. TeleVerify does not warrant the accuracy, completeness, or timeliness of any compliance result.

16.3 Professional Responsibility. Subscribers bear independent professional and legal responsibility for compliance with all applicable telehealth laws. Results are informational only and do not constitute legal advice.

16.4 OIG Screening. The Service includes OIG exclusion screening. OIG data is refreshed periodically but may not reflect the most recent updates. Covered entities should independently verify exclusion status through the official HHS OIG LEIE database.
